Terms of service

OVERVIEW

Welcome to LUMETRA. The terms “we,” “us,” and “our” refer to LUMETRA Sp. z o.o. LUMETRA operates this online store and website, including all related information, content, features, tools, products, and services (“Services”), to provide customers with a curated shopping experience.

The Services are powered by Shopify, which allows us to provide the platform for the store.

These Terms of Service (“Terms”) describe your rights and obligations when using the Services.

Please read these Terms carefully, as they contain important legal information, including disclaimers of warranties and limitations of liability.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

The Seller and owner of the store is LUMETRA Sp. z o.o., with its registered office in Warsaw, Al. SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that you are of legal age in your country of residence or that you have the consent of a legal guardian.

To place an order, you may be required to provide:

  • an email address
  • billing and shipping information
  • payment information

You confirm that all information provided is accurate and complete.

You are responsible for the security of your account and the activities conducted through it.

SECTION 2 – PRODUCTS

We make every effort to ensure that products are presented as accurately as possible. However, we cannot guarantee that the colors or appearance of the products will exactly match what you see on your device.

We reserve the right to:

  • modify product descriptions
  • change prices
  • withdraw products
  • limit quantities

SECTION 3 – ORDERS

By placing an order, the user makes an offer to purchase.

We reserve the right to accept or reject any order at our sole discretion.

The contract is not concluded until the order is confirmed.

If necessary, we may refuse to fulfill or cancel orders, and we will endeavor to notify you of this.

Returns and refunds are subject to our Return Policy.

Orders are intended solely for personal use and not for resale.

SECTION 4 – PRICES AND PAYMENTS

Prices are subject to change without notice.

The price listed at checkout is final.

Prices may not include:

  • shipping costs
  • taxes (if applicable outside of Poland)
  • customs duties (for international orders)

You agree to provide accurate payment information.

You confirm that:

  • the payment methods used are authorized
  • the charges will be paid in full
  • the billing information is correct

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by:

  • courier companies
  • customs clearance
  • external events

The risk of loss passes to the customer upon handover of the order to the carrier.

SECTION 5B – RIGHT OF WITHDRAWAL (CONSUMERS)

A consumer who has concluded a distance contract may withdraw from it within 14 days without giving any reason and without incurring costs, except for the costs specified by law.

The withdrawal period begins on the day the consumer or a third party indicated by the consumer takes possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement, e.g.:

The returned goods must be sent back without undue delay, no later than 14 days from the day of withdrawal, to the address indicated in SECTION 5A.

Reimbursement of payments will be made without undue delay, no later than 14 days from the day we receive the statement of withdrawal, using the same payment method used by the consumer.

The right of withdrawal does not apply in the cases specified in art. 38 of the Act of 30 May 2014 on Consumer Rights, including goods made to the consumer's specifications or serving their individualised needs.

SECTION 5C – COMPLAINTS

The Seller is obliged to deliver goods that conform to the contract and is liable to the consumer for any lack of such conformity (statutory warranty / non-conformity of goods with the contract).

  • in writing to the return address indicated in SECTION 5A

In the complaint, please provide a description of the defect, proof of purchase, and your requested method of handling the complaint.

The complaint will be considered within 14 days of its receipt. Failure to respond within this period means the complaint is deemed justified.

The consumer may use out-of-court methods of handling complaints and pursuing claims, including the online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

SECTION 6 – INTELLECTUAL PROPERTY

All content in the Services is the property of LUMETRA or its licensors and is protected by intellectual property laws.

You may not:

  • copy or reproduce the content
  • distribute or modify the content
  • use trademarks without permission

All rights not expressly granted are reserved.

SECTION 7 – OPTIONAL TOOLS

We may provide third-party tools.

These are provided “as is,” without any warranties.

You use them at your own risk.

SECTION 8 – LINKS TO THIRD-PARTY SITES

The Services may contain links to third-party websites.

We are not responsible for:

  • content
  • the accuracy
  • the policies of third-party websites

You use them at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

LUMETRA operates on the Shopify platform.

However, all purchases are made directly from LUMETRA Sp. z o.o.

Shopify is not responsible for transactions, products, or customer complaints.

SECTION 10 – PRIVACY POLICY

Your personal data is processed in accordance with our Privacy Policy.

By using the Services, you consent to such processing.

SECTION 11 – FEEDBACK

By submitting feedback, reviews, or suggestions, you grant us a worldwide, royalty-free, perpetual license to use them for any purpose, including for marketing purposes.

You confirm that:

  • you own the content
  • it does not infringe on the rights of third parties
  • it is lawful and accurate

SECTION 12 – ERRORS AND INACCURACIES

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed.

SECTION 13 – PROHIBITED USES

You agree not to use the Services to:

  • any illegal activity
  • fraud or abuse
  • disrupting the operation of the website
  • spam or phishing
  • data scraping
  • unauthorized resale

If you violate these rules, we may suspend or block your access.

SECTION 14 – TERMINATION

We may terminate your access to the Services at any time without notice.

Certain provisions will survive termination, including those regarding liability, intellectual property, and legal obligations.

SECTION 15 – DISCLAIMER REGARDING THE OPERATION OF THE SERVICE

This section concerns solely the technical functioning of the online service (the website and platform) and does not apply to the goods sold through it.

The service is provided “as is” and “as available.” We do not guarantee that:

  • the service will operate without interruption,
  • the operation of the service will be error-free,
  • the service will meet the user's individual technical expectations.

The above disclaimers relate solely to the technical operation of the service and in no way concern the quality, conformity with the contract, or warranty of the goods sold. They do not affect consumer rights arising from mandatory provisions of law, including rights under the statutory warranty (rękojmia), guarantee, and liability for the conformity of goods with the contract.

SECTION 16 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, LUMETRA shall not be liable for:

  • consequential damages
  • loss of profits
  • loss of data
  • business interruption

SECTION 17 – INDEMNIFICATION

You agree to hold LUMETRA harmless from any claims arising from:

  • a breach of the Terms
  • violation of the law
  • improper use of the Services

SECTION 18 – SEVERABILITY

If any provision is found to be invalid, the remaining provisions remain in full force and effect.

SECTION 19 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and LUMETRA.

SECTION 20 – ASSIGNMENT

We may assign our rights. You may not assign your rights without our consent.

SECTION 21 – GOVERNING LAW

These Terms are governed by Polish law.

Any disputes will be resolved by the competent courts in Poland.

SECTION 22 – CHANGES

We may update these Terms at any time.

Your continued use of the Services constitutes acceptance of the changes.
